ASSUMPTION OF RISK AND
INDEMNITY AGREEMENT FOR JUNGLE TUBING

• I understand that tubing is an inherently dangerous activity; and I knowingly and voluntarily assume all risks inherent thereto, including but not limited to the risk of drowning, of striking submerged, floating, or fixed objects, and all other unspecified risks.
• I fully understand and acknowledge that risks and dangers exist in my participation in Jungle Tubing and accept these risks.
• I hereby release, waive, and discharge Backtrax Tours, its shareholders, directors, officers, employees, and agents from all liability to myself, my personal representatives, all assigns, heirs, and next of kin for any and all loss or damage, and any claim or demands therefore on account of injury and/or death to myself and/or property damage, now and forever, arising out of or related to participation in said activity.
• I hereby assume full responsibility for any risk of bodily injury, death, or property damage, now and forever, arising out of or related to participation in said activity, whether foreseen or unforeseen.
• I hereby acknowledge that this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement extends to all acts and is intended to be as broad and inclusive as permitted by the laws of Thailand.
• I have read this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement, fully understand its terms, am aware of its legal consequences, and have agreed to it freely and voluntarily and intend my agreement to be a complete and unconditional release of all liability to the greatest extent allowed by law.
